Terms of Service

1. About these Terms

These Terms of Service ("Terms") govern your use of:

• the Hushbench website and web app at https://hushbench.msweelam.dev, and the old address fvp-web.msweelam.dev (which shows a notice that the site has moved); and
• the Hushbench online account and purchase service on that website (see section 9).

Together these are the "Service". The Service is run by SweBYS, Oman ("we", "us", "our").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. How these Terms fit with our other documents

• Your use of the Hushbench software itself (web app, desktop app and downloadable copy), including Free and Pro features and license files, is governed by our End User License Agreement ("EULA").
• Our Privacy Policy explains how we handle personal data.
• Our Refund Policy explains refunds.

If these Terms and the EULA conflict about the software, the EULA wins.

3. Who can use the Service

You must be at least 16 years old, or have the permission of a parent or guardian, to use the Service.

If you use the Service for an organization, you confirm you have authority to accept these Terms for it.

4. Using the website

The web app is free to use without an account. You agree not to:

• attack, overload, probe or disrupt the Service, its hosting or its security;
• use automated means to access the Service in a way that places an unreasonable load on it;
• mirror, copy or republish the website or web app;
• misuse the visitor counter or any API endpoint (for example, by trying to inflate or manipulate the count);
• use the Service in breach of any law or anyone else's rights.

5. Your content stays with you

The web app processes your files and pasted content locally in your browser. Your content is not uploaded to us, and we do not claim any rights in it. You are responsible for the content you choose to process and for having the right to process it.

6. Downloads

Download the desktop app and the downloadable copy only from the Hushbench website (https://hushbench.msweelam.dev) or from a link we publish there. Copies from other sources may be altered and are not supported.

7. Availability and changes

We provide the Service "as available". We may change, suspend or stop any part of the Service, including features of the web app, without notice where reasonable. We are not liable for any unavailability.

If we stop the online account and purchase service, we will tell customers with an active subscription at least 30 days in advance. License files already issued keep working until they expire, and the Refund Policy explains refunds for prepaid time.

8. Issue reports and links to other services

• Issue reports. "Report an issue" opens our public issue tracker on GitHub (https://github.com/sweelam/fvp-issues/issues). Reports there are public. Do not include personal data, secrets or confidential content in an issue. GitHub's own terms and privacy policy apply on GitHub.
• Feedback. If you send us feedback or suggestions, we may use them without any obligation to you.
• Other sites. The Service links to sites we do not control (for example GitHub, Paddle and Google). We are not responsible for them.

9. Online accounts and purchases

9.1 Accounts

• You sign in with your Google or GitHub account, or another sign-in method we offer on the account page. We do not use passwords.
• Keep access to your sign-in accounts secure. You are responsible for activity on your Hushbench account.
• Give us accurate information, and keep the email address on your sign-in account up to date.
• One account is for one person. A Team plan is bought by one account for the number of named people (seats) stated in it.

9.2 Purchases through Paddle

• Purchases are processed by Paddle, which acts as Merchant of Record. Paddle is the seller of record: it takes payment, calculates and collects sales tax and VAT, and issues invoices and receipts.
• Paddle's own buyer terms and privacy policy apply to the purchase and payment. Your card details go to Paddle and never reach us.
• What you receive (the Pro license) is governed by our EULA.

9.3 Subscriptions

• Pro and Team are offered as monthly or yearly subscriptions at the prices shown on https://hushbench.msweelam.dev/pricing, in US dollars. Sales tax or VAT is added or included at checkout depending on where you live. There is no free trial; the Free tier of Hushbench is free to use.
• Subscriptions renew automatically at the end of each period, at the then-current price, until canceled.
• Your subscription is delivered as license files. A license kept in your browser is valid for about 35 days and renews automatically while you are signed in and the subscription is active. A downloaded license file on a yearly plan, and any Team license, runs to the end of the paid period; other downloaded files run for about 35 days. The desktop app renews downloaded files automatically when it is online and the subscription is active.
• Price changes. We may change subscription prices. Changes apply from your next renewal, and we will tell you by email at least 30 days in advance.

9.4 Cancelling

• You can cancel at any time from your account page (https://hushbench.msweelam.dev/account), using Manage billing, or by emailing hushbench.support@gmail.com.
• Cancelling stops renewal. Your current license keeps working until it expires (plus the 7-day grace period described in the EULA), after which the app reverts to the Free tier.
• Refunds are covered by our Refund Policy.

9.5 Closing your account

You can delete your account at any time on your account page (Delete account), or ask us to by emailing hushbench.support@gmail.com. A subscription that would still renew must be canceled first. See the Privacy Policy for what we keep and for how long.

10. Enterprise purchases

Organizations may buy Pro by purchase order and invoice. These purchases are governed by the EULA and the Order (purchase order, quote or invoice). Where they conflict, a signed Order takes precedence for that purchase, then the EULA, then these Terms.

11. Suspension and termination

We may suspend or end your access to the Service (including your account) if you breach these Terms or the EULA, if required by law, or to protect the Service or other users. Where reasonable, we will tell you first and give you a chance to fix the problem.

If we end a paid account because you breached these Terms or the EULA, you are not entitled to a refund, except where the law requires one. If we end it for any other reason, we will refund the unused part of any prepaid period.

You may stop using the Service at any time.

12. Disclaimer

Some laws give you rights that cannot be excluded. Nothing in these Terms removes them.

Apart from those rights, the Service is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability and non-infringement.

13. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law (for example, for death or personal injury caused by negligence, or for fraud).

Subject to that:

• we are not liable for indirect, incidental, special or consequential loss, or for loss of data, profits, revenue, business or goodwill; and
• our total liability arising from or in connection with the Service is limited to the amount you paid us in the 12 months before the claim.

14. Indemnity

If you use the Service for business purposes, you will cover our reasonable losses from claims by third parties that arise from your breach of these Terms or your misuse of the Service. This section does not apply to consumers.

15. Changes to these Terms

We may update these Terms. We will post the new version here with a new "Last updated" date and, for changes that matter, tell account holders by email at least 30 days before they take effect. If you keep using the Service after the changes take effect, the new Terms apply.

16. Governing law and disputes

These Terms are governed by the laws of the Sultanate of Oman. Disputes will be handled by the courts of Muscat, Oman. If you are a consumer, you keep any protection given by the mandatory laws of the country where you live.

Before starting a formal dispute, please contact us at hushbench.support@gmail.com so we can try to resolve it within 30 days.

17. General

• Entire agreement. These Terms, together with the EULA, Privacy Policy, Refund Policy and any Order, are the whole agreement between us about the Service.
• Assignment. You may not transfer your rights under these Terms without our consent. We may transfer them to a successor of the Hushbench business.
• Severability. If part of these Terms is found unenforceable, the rest stays in effect.
• No waiver. If we do not enforce a right straight away, we can still enforce it later.
